Terms & Conditions

  1. For the purpose of these terms and conditions, the following words shall have the following meanings:



    1. "Us/we" shall mean Turner Broom Plumbing Limited.

    2. "You" shall mean you: the customer (the person or organisation for whom we agree to carry out works and/or supply or materials)

    3. "Our representative" shall be the person we send to you to do work



  1. Prices are open to acceptance up to three months from date of estimate.



  1. Fixed Price work. Quotes will generally include labour and materials. The price will be fixed but manifest errors shall be exempted. Revision to quotes may occur if:




    1. You change the scope of the work

    2. There is an increase in the price of materials

    3. Further works turn out to be needed to do the work.

    4. Impossible for us to do the work for the previously quoted fixed price, we will give you a free quote for the work so that you can choose to use us or not.



  1. Damage - Turner Broom Plumbing Ltd accept no responsibility for any damage to the property whether structural or aesthetical whilst undertaking any work.



  1. Delay - Due to scheduling requirements a minimum of 5 days notice is required if the start date is to be postponed by the customer. Changes to works schedule by the customer after this period will be charged at a rate of £100 per day.


  2. Cancellation - The customer will forfeit a deposit equal to 25% of the total job cost including vat, if the job is cancelled within 5 working days of the scheduled start date.


  3. Dates given for commencement of work are approximate only. Whilst every effort will be made to keep to a given date, work can sometimes be delayed. The customer will be notified near the expected date.



  1. All labour carried out is guaranteed for 100 days from date of completion.



  1. All materials used are guaranteed as per manufactures warranty.



  1. Unfortunately no guarantee will be given on materials if they are not supplied by Turner Broom Plumbing Ltd, unless it has been agreed beforehand. We only supply quality materials from well-known brands that we are used to dealing with.



  1. Title and ownership of the materials and equipment will not pass to the customer until final payment has been made. Any materials can be recoverable by Turner Broom Plumbing Ltd in the event of non-payment. The customer agrees to allow access to site for this purpose.



  1. At any time and without notice we shall also be entitled to enter any premises in which our goods, or any part of them, are installed, stored or kept or it is reasonably believed to be so. We shall be entitled to seek a court injunction to prevent you from selling, transferring or otherwise disposing of such goods. However, the risk in the goods will pass to you on delivery to you. You must insure them at replacement value and if asked you must produce evidence that they are properly insured.



  1. We shall be entitled to recover the costs or damages from any person or contractor whose negligence or faulty workmanship makes us liable to pay for those damages or rectification of work.



  1. Things we cannot cover. We are unable to guarantee our work, parts and equipment supplied to you: if they are misused, treated negligently or if our work is repaired, modified, or tampered with by anyone other than us. Where we carry out works for you using your materials we can take no responsibility for the quality, fitness for purpose or otherwise of these materials so we cannot accept responsibility for them.



  1. We cannot guarantee work where you order us to carry out work against the advice of our representative. This advice will be given to you either orally, or in writing. Our guarantee is also void if we indicate that further works need to be carried out.



  1. We cannot guarantee (because of its nature) any work to unblock waste or drainage pipes. Nor can we guarantee further damage or defects caused by work that is not fully guaranteed or where recommended further work has not been carried out.



  1. We cannot guarantee work on existing installations that are either inferior or over 10 years old nor can we guarantee the effectiveness or otherwise of our work in these cases.



  1. We will only be liable for rectifying our own work and shall not be held responsible for any ensuing damage or claims resulting from this or other work overlooked or subsequently requested and undertaken at that time.



  1. Materials purchased as a result of work you instruct us to undertake will be charged to you if you later cancel. Charges will be those of our normal terms and conditions



  1. We cannot guarantee our work, parts and equipment supplied to you if:



    1. They suffer misuse, treated negligently or if our work is repaired, modified, or tampered with by anyone other than us.

    2. We carry out works for you using your materials.

    3. You order us to carry out work against the advice of our representative. This advice will be given to you either orally, or in writing.

    4. We indicate that further works need to be carried out.

    5. Existing installations are either inferior or over 10 years old nor can we guarantee the effectiveness or otherwise of our work in these cases.



  1. We reserve the right to decline to undertake any work.



  1. Work carried out as a result of advice given by Turner Broom Plumbing Ltd by any party except us is the responsibility of that party and not in any way the responsibility of Turner Broom Plumbing Ltd. If any advice, recommendations, or any situation stemming from consultation with Turner Broom Plumbing Ltd is given by us but subsequent work is carried out by anybody else except Turner Broom Plumbing Ltd we accept no liability for any problems whatsoever encountered with said work, advice or recommendations.



  1. Gas. You will be solely liable for any hazardous situation in respect to the CORGI gas regulations or any Gas Warning Notice issued. Our representatives operate under their own CORGI registration and are therefore solely liable for any gas work and its subsequent liability.

Payment Terms

  1. Payment Terms - Upon instruction of works to Turner Broom Plumbing Ltd, a deposit of 50% of the total cost is requested when the total cost is £5,000 or less PRIOR to commencement, a minimum of 10 working days in advance. If the total is £5,001 or more than a 40% deposit is required and a further 40% is payable during works. The balance is payable immediately on the last day of works. If the customer fails to pay the agreed instalments on or before the due date Turner Broom Plumbing Ltd will cease work and enforce payment of the balance of the contract price. Turner Broom Plumbing Ltd reserves the right to charge interest at a rate of 3% per month on any amounts unpaid after the due date of the final invoice. Should you request any work additional to that detailed above, you will receive a separate quote and the work will be invoiced separately. If our terms and conditions are not met, the invoice will be adjusted to include interest payable at 3% per month above base. If the customer fails to pay the agreed instalments on or before the due date, Turner Broom Plumbing Ltd will cease work and enforce payment of the balance of the contract price.



  1. With all works of any price the balance is payable upon completion of the works initially agreed upon. Any additional work necessary, and agreed upon by the customer, will itself be subject to these terms.



  1. These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by our duly authorised representative and you. Our terms and conditions shall prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions.



  1. These terms and conditions and all contracts awarded between us and you shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Law.



  1. By accepting the estimate given by Turner Broom Plumbing Ltd the customer is also accepting these Terms and Conditions.
